Angela Gabriel Branch ChairWelcome to the website for the Leeds & York Community & Health Branch of UNISON. This website brings together UNISON members from Leeds Community Health Branch of UNISON and members recently transferring into the Branch from North Yorkshire & York.

As a branch we actively campaign for high quality services in the NHS and voluntary sector. We feel that good working conditions and environments are essential to delivering high quality care. This branch has representatives that are actively involved in negotiating policies which affect your day to day working lives.

We support members in all areas of Community & Health services and strive to deliver a first class service to our members.

UNISON NHS Pension Ballot

Important advice about NHS Pension Ballot (12/04/12)

(12/04/12) At the Service Group Executive there was a decision to send the offer out with “a recommendation that this is the best that can be achieved by negotiation”. This was carried by 21 votes to 11 with 2 abstentions. Those voting against had argued for a recommendation to reject which was clearly defeated.

However a recommendation to recommend acceptance was unanimously lost.

It was also agreed at the SGE that members should be given full access to information on what the offer means and that the consequences of rejection should be fully explained. The consequences of rejection are:

  • There is a risk that the government would impose a worse offer and in particular that the offer regarding Fair Deal would be removed. Ministers have said this consistently throughout the negotiations.
  • Rejection would also mean the union would be asking members to take sustained industrial action. It is quite clear that rejecting the offer and then doing nothing would not force the government to improve the offer. Sustained industrial action would require more than the one day of action as taken in November and could mean bringing out specific occupational groups, members across a geographical area or targeting specific employers, either on a rolling programme or specific periods or on an all- out basis. In addition the strike on 30th November was across the public sector which meant the fact that several health unions, including the BMA and RCN were not involved, had less of an impact on us. However if there is any future strike action taken by UNISON members in health, it is unlikely there would be support from either the majority of health unions or indeed other major public sector unions.

In health the position of the other unions is that although some have rejected, they have not indicated that they intend to take any action. Indeed the RCN have stated they will not take action.

These recommendations are actually in line with the decision of our own Regional Health Care Service Group Committee, which voted overwhelmingly to put any offer to our members with the full information and let them make the decision.

NHS Pensions Ballot: FAQS (12/04/12)

When is the ballot happening?
The ballot opens 11 April and closes at 10am on 27 April

Who is being balloted?
All current members who have access to the NHS pension scheme will be included in the ballot. This includes members who have deferred their pension scheme but are still working in the NHS.

If you are an active member of the NHS pension scheme and have not received a ballot paper by 17 April, contact the ballot helpline on 0845 355 0845. The ballot helpline closes at 11am on 25 April.

How do I vote?
As this is a consultative ballot, and not an industrial action ballot, you can vote online or by post.

You will receive an individual ballot paper with two security codes, which will be checked against all postal and online voting to ensure just one vote per member is received. You can either vote online or return your paper by post.

All ballot papers and online votes will need to be received by 10am on 27 April.

Can I vote online and what is the process?
Yes, during the ballot period you can go online at votebyinternet.com/UNISONHealthPensions2012 and enter the two security codes from your ballot paper to vote online.

If you are an active member of the NHS pension scheme and have not received a ballot paper by 17 April, contact the ballot helpline on 0845 355 0845. The ballot helpline closes at 11am on 25 April. 

What happens if don't get a ballot paper? 
If you have access to the NHS pension scheme and have not received your ballot paper by 17 April then you can call UNISONDirect on 0845 355 0845 to request a ballot paper. The ballot helpline closes at 11am on 25 April. 

When will results be published? 
The ballot results will be published on 27 April. 

What happens next if the result is to reject the proposals? 
The ballot paper identifes that by rejecting, members are giving their approval to UNISON's Health Service Group committee to recommend further industrial action.

Can I vote if I have just joined? 
Yes. Phone UNISONDirect on 0845 355 0845 between 17 April and 11.00 on 25 April to request a ballot paper.

Leeds Community Health Annual Report published (27/01/12)

Annual Report 2011The branch produce an attractive Annual Report every year, detailing the work of branch which goes on 365 days of the year! It is actually well worth a read (even though we say so ourselves!).

Highlights this year include some great photos of the Day Of Action held on 30th November - where members took a stand against the unfair pension proposals.

UNISON's professional indemnity cover for health care workers (27/01/12)

UNISON provides professional indemnity cover for members working in health care.

The below question and answer sheet tells you not only the extent of UNISON's cover but also the responsibilities of your employer regarding incidents of professional malpractice.

What is professional indemnity cover for?
It means that UNISON will cover you for any claim made against you for professional malpractice incurred by yourself in the course of your employment as a health care worker.

UNISON provides cover for all health care employees including nurses, health visitors, midwives (except those working outside the NHS), ambulance workers, professions allied to medicine, PTA and PTB staff, administrative and clerical workers, managers and ancillary staff.

UNISON provides cover whether you are working inside or outside (with the exception of midwives) the NHS.

Is there a limit to UNISON's indemnity?
Yes, there is a limit of £1,000,000 for any one claim.

Does my employer have any responsibilities?
Yes your employer does have responsibilities. That is why UNISON's cover is what is called "contingent" or "fall back" cover.

All organisations involved in the provision of health care, both inside and outside the NHS, have a duty of care and are vicariously liable for that actions of all staff who are directly or indirectly under their employment. This includes voluntary organisations that have a duty of care to their volunteer workers.

What is NHS indemnity?
The NHS takes its' responsibilities regarding vicariously liability very seriously. In its' booklet "NHS Indemnity: Arrangements for clinical negligence claims in the NHS", it makes it clear that: "NHS bodies should accept full financial responsibility where negligent harm has occurred, and not seek to recover their costs from the health care professional involved".

The NHS fully accepts its responsibility for the actions of not only those working under a contract of employment with a NHS body, but also agency staff, students and volunteers.

Therefore, although UNISON continues to provide such cover, there are no foreseen circumstances in which a NHS employee is likely to be sued for their actions.

Then why do I need UNISON's cover?
UNISON's cover is for the rare occasions where the employer's cover fails to protect the employee (subject to the exemptions listed below).

Am I covered if I work overseas?
Yes, with the exception of any work carried out in USA (including Protectorates) and Canada.

Am I covered if I am a student?
Yes. In addition if you are a student working on a placement under the supervision of a NHS employer you are covered by NHS Indemnity.

Where there are clinical placements outside of the NHS, then whoever is providing the placements (ie nursing homes, residential home or private hospital) is vicariously liable for your action.

UNISON however provides cover if for any reason this cover should fail, as long as appropriate supervision is provided.

Are there any other exemptions to UNISON's cover?
Yes. The following groups are exempt from UNISON's cover:

  • Midwives working outside the NHS
  • Medical practitioners
  • Expert witnesses
  • Self employed independent practitioners and individuals working on a fee for service basis
  • Beauty treatments or medico legal work (other than those employed by the NHS)
  • All claims relating to transmission of hepatitis non A (outside the NHS).
    Please note UNISON did not wish to exclude these groups. The decision to exclude these groups was taken at the instruction of its underwriters.

Despite these exclusions this is the most comprehensive professional indemnity cover package UNISON has provided for its health care members since its formation in 1993.


 

Pensions latest (04/01/12)

UNISON is gearing up to take the pensions campaign forward in 2012 with our third pensions summit, bringing together lay activists from across the union, taking place at the UNISON Centre on 10 January.

All the service group executives involved in the NHS and local government pension schemes will meet on the same day to consider the latest updates from the sector negotiations and decide the way forward.



2012 Service Group Executive elections (04/01/12)

The nomination period for election of the union's service group executives will open on Tuesday 10 January 2012. The nomination period closes at 5pm on Friday 17 February 2012.
